The Better Business Bureau (BBB) lists 197 complaints against Ace Cash Express since 2015. These complaints allege that the company uses unfair, abusive, and deceptive practices when attempting to collect on a debt, including:

  • Threatening to use violence against a consumer
  • Mismanaging consumer payments
  • Debiting consumer bank accounts without permission
  • Failing to make payments on bills when consumers use their bill pay service
  • Contacting third parties about a debt
  • Debiting consumer bank accounts twice for the same payment
  • Attempting to collect fees and charges not included in the contract

Consumers have also filed 481 complaints with the Consumer Financial Protection Bureau (CFPB), a federal agency created to help prevent companies in the financial industry, such as banks, credit card companies, and debt collection agencies, from abusing and deceiving consumers. In these complaints, consumers allege that Ace Cash Express:

  • Threatened to take action it had no legal right to take
  • Refused to take payments or made it impossible for consumers to make them
  • Falsely implied that a consumer would be arrested if they did not pay
  • Failed to provide consumers with the mini-Miranda
  • Falsely implied that a communication was from an attorney

While Ace Cash Express is not subject to the federal Fair Debt Collection Practices Act (FDCPA), many of these practices are violations of similar state laws, such as California's Rosenthal Fair Debt Collection Practices Act (RFDCPA) which mirrors the federal Act, but applies to original creditors and not just third party debt collectors. These laws were enacted in order to prevent creditors and debt collectors from using unfair, deceptive, or abusive practices when attempting to collect on a debt. Practices specifically prohibited by the FDCPA, and similar state laws, include:

  • Contacting third parties about a debt
  • Threatening to take action they have no legal right to take
  • Falsely implying that a consumer will be arrested if they do not pay
  • Attempting to collect fees and charges not included in the original contract
  • Using abusive, profane, or obscene language
  • Calling consumers before 8:00 a.m. or after 9:00 p.m.
