Has a debt collector or creditor allowed your phone to ring continuously?
Under the FDCPA a debt collector may not allow your phone to ring and ring in an attempt to annoy or harass you into paying the debt or speaking with them about a debt. While the Act does not specify what continuous ringing means, most people know that after five to seven rings, the person being called is not going to answer and no voicemail is going to pick up, and they hang up. Creditors and debt collectors, however, may not use the same common sense when calling to collect a debt, especially since many of them are paid commission when they successfully collect.
Debt collectors and creditors are notorious for making repeated phone calls and may let the phone ring until it wakes you up or causes you to answer out of frustration, or make back to back calls hoping you will tire of hearing the phone ring and answer it. You should not have to live in fear of your phone ringing!
