The BBB and Consumer Financial Protection Bureau (CFPB), a federal agency created to help ensure that companies in the financial industry, such as banks and collection agencies, do not harass or abuse consumers, report no complaints against ABC Collectors, Inc. Although, the agency has been sued at least once, in California, for failing to identify the call as an attempt to collect on a debt, which is a violation of the Fair Debt Collection Practices Act (FDCPA).  The FDCPA requires that debt collectors provide consumers with the mini-Miranda, which tells the consumer that the call is an attempt to collect on a debt and any information obtained during the call will be used for that purpose. The Act also prohibits debt collectors from using many types of deceptive, unfair, and abusive collection practices including:

  • Causing a consumers telephone to ring repeatedly
  • Using obscene or profane language
  • Falsely implying that the call or letter is from a law enforcement or government agency
  • Calling consumers before 8:00 a.m. or after 9:00 p.m.
  • Threatening to take any action that it cannot legally take or does not intend to take
  • Falsely implying that the consumer is committing a crime by not paying a debt
  • Communicating with a third party about a debt

This list is not all inclusive of the prohibited acts under the FDCPA. The Act not only prohibits many deceptive and abusive practices; it also requires debt collectors to do certain things, such as to provide consumers with basic information about the debt such as the amount and the name and address of the original creditor so that the consumer can verify they actually owe the debt before deciding whether to pay it, and notice that they have thirty days to dispute the debt before it is assumed to be valid. It further requires them to cease all communications with a consumer if they are asked in writing to do so, or if they are informed that the consumer has no intention of paying the debt.
