According to the debt collection agencies website, it collects in a “professional manner, with integrity, and responsibility”. A look at some of the online complaints filed against agency would seem to tell a different story. The BBB reports 252 complaints against Ability Recovery Services LLC in the last three years. A large majority of the complaints allege that the company is difficult to get a hold of, uses auto-dialers, attempts to collect on accounts that have been paid in full, makes unauthorized debits to consumer's bank accounts, and that representatives are rude and hang up on consumers, particularly when asked for an address for the agency. Many violations of the FDCPA are alleged, including:
- Falsely reporting credit information to the credit reporting agencies
- Failing to provide consumers with enough information to verify debts
- Calling consumers at work
- Using abusive or profane language
- Adding fees and expenses not authorized by the original contract
- Contacting consumers after being asked not to
- Speaking with third parties about a consumer's debt
- Failing to disclose calls as attempts to collect on a debt
A number of the complaints filed are about billing disputes, where the collection agency is attempting to collect a debt owed to a healthcare provider that the consumer believes his or her health insurance should have/did pay. However, the consumers all allege that they knew nothing about the unpaid amount until Ability Recovery Services, LLC appeared on the credit report as having an unpaid collection account.
The Consumer Financial Protection Bureau (CFPB) lists 377 complaints filed against the collection agency since 2015. Complaints are similar to those filed with the BBB alleging that the agencies customer service representatives are abusive, talk down to consumers, and frequently hang up on them. Many of the complaints are about accounts with educational institutions, most of which are not accredited, who accepted payment arrangements, payment in full, or forgave consumer accounts, but according to Ability Recovery Services, LLC, neglected to report that information to the collection agency. Consumers are then apparently unable to get the agency to stop collection attempts even after speaking with the educational institutions to verify that they do not owe any money and do not have an account in collections.
