In the last three years, the Better Business Bureau (BBB) has received 83 complaints against the collection agency and the Consumer Financial Protection Bureau (CFPB), a federal agency created to help ensure that debt collectors, and other companies in the financial industry, do not abuse consumers, has received over thirty complaints since 2015.

A large majority of the complaints allege that Bay Area Credit Service, LLC reported false information to the credit reporting bureaus by reporting collection accounts to the wrong consumer's reports. The company commonly responds to the consumers and to these complaints by saying they are not being given enough information to locate or verify the account. This seems to put consumers between a rock and a hard place because they are claiming the account does not belong to them and should be removed from their credit report and the collection agency says it needs more information to verify and remove the account, which the consumer obviously cannot provide, because the account does not belong to them.

Complaints against Bay Area Credit Service, LLC also allege that it:

  • Calls consumers repeatedly, even several times in one day
  • Attempts to collect on debt that has already been paid
  • Refuses to provide debt verification
  • Attempts to collect the wrong amount
  • Continues calling consumers after being asked to stop
  • Speaks to third parties about consumer's accounts
  • Repeatedly calls numbers after being told it is the wrong number
  • Reports credit information it knows, or should know, is false

These are violations of the Fair Debt Collection Practices Act (FDCPA) a federal Act passed to help ensure that debt collectors do not harass or abuse consumers when attempting to collect on a debt, and the Rosenthal Fair Debt Collection Practices Act (RFDCPA) a California Act that mirrors the federal Act and also provides protections against original creditors, who are not covered by the federal Act.
